Photo Licensing Questions

I have a commercial customer who is wanting to license an image for their company logo. I have not been able to find any information out there on licensing for a logo. Can anyone share their experience on pricing for this license? I am thinking this would be in the $30,000 - $50,000 range, but not sure and don't want to lose the sale because I am too high, but don't want to lose money because I am too low.  I have licensed images for other usages but cannot find any information on logo licensing.  I have been told this is unique but no answers.

An update to the case. On 14 Feb 2012, in US District Court for Central District of California, Western Division, the court issued a Default Judgment against one defendant, Todd Dorff dba Mason Bay Media, the graphic designer, web designer and hosting company, for statutory damages. The court ruled in my favor. The judge stated he found it to be "Willful and Intentional Infringement" and awarded me statutory damages in the amount of $150,000 plus costs of $900 plus attorney's fees of $6,600. The judge also issued a injunctive relief regarding the continued use of the image stating "Defendant’s agents, servants, employees; and all persons in active concert and participation with Defendant who receive actual notice of the injunction are hereby permanently restrained and enjoined from infringing Plaintiff’s Copyright in and to the Photograph, in any manner, including generally, but not limited to, copying, altering, or displaying the Photograph or the Logo unlawfully derived therefrom, whether on the jsrodeo.com website, any other website or web page, on physical goods, printed matter or otherwise, without the express prior written consent of Plaintiff.".

The judge stated in his ruling "Defendant’s infringing conduct is a clear and unmistakable violation of Plaintiff’s rights. Defendant’s conduct has been patently unreasonable and egregious, violating Plaintiff’s rights by appropriating the Plaintiff’s Copyrighted Photograph for a company Logo, when Defendant intended or knew or should have known that such infringing activity would likely injure Plaintiff, deprive Plaintiff of income flowing from his exercise of exclusive rights granted to the owners of copyright, requiring Plaintiff to institute and prosecute this action, and incur fees and costs in so doing, for Defendant’s commercial gain and personal profit. Considerations of appropriate compensation and adequate deterrence also militate in favor of granting Plaintiff an award of attorneys’ fees, pursuant to 17 U.S.C. § 505."

As of this time the remaining defendants have failed to take down the image from many websites per the injunction issued by the court. Therefore I am proceeding with a claim of Contempt of Court and Summary Judgment against the remaining defendants in the case.

If anyone knows of a good collection agency or collection attorney, I would appreciate them forwarding the name (s) to me, as I want to start trying to recover my award.

Yes, and we still have 4 defendants to go in the suit.  The rodeo company's insurance is looking at it now.  I will keep you updated.

Incidentally, who is your attorney? I live in California and I would like to find an attorney who lives here and specializes in intellectual property, specifically photographers.

Thank you Trigger.  I know I will get something, it is just whether or not the attorney is going to get the $17,000 she claims she has in the case.  And this is all before depositions where we will learn who else was involved in making money off of my image.

Rights for use of imagery in logos are usually sold or transferred outright to the company as they may want to use the image in a multitude of situations potentially for many years. This of course would affect the pricing of the image but the size of the company would also be a predominant factor in how much to charge.

Thanks for the comeback, but the information you provided as an answer is not the information asked for.  I am looking for a price range for licensing an image, which btw, is illegally being used without my consent, as a company LOGO.  I understand how the process works, as stated in my post, I have licensed many images in the past, but I am specifically looking for pricing on a LOGO.

I must have misunderstood, my apologies, but I would expect the rate to be based on the size of the company. We don't have that info and as there's also infringement of your copyright now so I'd seek legal advice.

No problem Trigger.  I think it would partially be based on the size of the company in the industry the company is involved.  But I think there would be a starting point just for the purpose of a LOGO usage.

I have an attorney working on it but the attorney has been unable to find a range for the use of a LOGO either.  The attorney has asked my help in finding some type of standard.  The image was registered before the infringement, so I will ask for the statuary damages for the willful infringement of a registered image, but the court also asks what the industry standards are, for this type of usage before the intentional infringement.  In addition to using it as the LOGO the company has also plastered it over websites in it's original form.  Another infringement that was not contracted for, so that will add to the cost for the use of the image.
