I recently shot a mini-catalog for a local men's clothing store. I have been asked to use the photos shot for the catalog to produce a slideshow for use on the owners website and Facebook fan page. The slideshow will be used to promote a summer/fall sale and will be up for about four months. How do I charge for licensing of the final product for web and facebook use?
The most logical way is a added percentage on the original fee. Typically 20 to 40%
The one additional question I would have- and I have no idea what the answer is- is that if you are making money by selling them to the store, not working with the manufacturer, are you in violation of copyright laws if the clothes have logos on them?
I suppose that this isn't really an issue otherwise much of fashion photography would be in violation of the brand's trademarks. I know that there are (were?) some cases in the court system regarding the trademarking of styles but what about in the case of actual brand logos?
If there is no copyright/trademark violation in this case, does anyone know what the loophole is? Any thoughts on this?
